Powers and Duties of the Punong Barangay

The Punong Barangay is the head of the barangay government and exercise, such powers, duties and functions as are provided in the Local Government Code and other laws.
Powers and Duties
For efficient, effective and economical governance, the purpose of which is the general welfare of the barangay and its inhabitants pursuant to Section 16 of Local Government Code, the Punong Barangay shall:
1. Enforce all laws and ordinances which are applicable within the barangay;
2. Negotiate, enter into, and sign contracts for and in behalf of the barangay, upon authorization of the sangguniang barangay;
3. Maintain public order in the barangay and, in pursuance thereof, assist the city or municipal mayor and the sangguniang members in the performance of their duties and functions;
4. Call and preside over the sessions of the sangguniang barangay and the barangay assembly, and vote only to break a tie;
5. Upon approval by a majority of all the members of the sangguniang barangay, appoint or replace the barangay treasurer, the barangay secretary, and other appointive barangay officials;
6. Organize and lead an emergency group whenever the same may be necessary for the maintenance of peace and order or on occasions of emergency or calamity within the barangay;
7. In coordination with the barangay development council, prepare the annual executive and supplemental budgets of the barangay;
8. Approve vouchers relating to the disbursement of barangay funds;
9. Enforce laws and regulations relating to pollution control and protection of the environment;
10. Administer the operation of the katarungang pambarangay in accordance with the provisions of the Local Government code;
11. Exercise general supervision over the activities of the sangguniang kabataan;
12. Ensure the delivery of basic services as mandated under Section 17 of the Local Government Code;
13. Conduct an annual palarong barangay which shall feature traditional sports and disciplines included in national and international games, in coordination with the Department of Education, Culture and Sports;
14. Promote the general welfare of the barangay; and
15. Exercise such other powers and perform such other duties and functions as may be prescribed by law or ordinance.

Barangay History during Pre-Spanish Times

The word Barangay originally referred to the settlement of Malay people, who, according to H. Otley bayer "filtered in fleets of dugouts boats, up from the west coast of Borneo into Luzon via Palawan and Mindoro, and in another ocean pathway through the Celebes Strait to Mindanao and the Visayas." These people, who became the ancestors of the present-day Filipinos, came in groups composed of the head and the immediate members of his family. They traveled by sailboat called "Balang" and founded independent settlements along the coast in the different islands of the archipelago.
According to historians, the Barangay settlement was similar to the districts of old Rome. The head of each of these groups was usually the oldest or the strongest member called Datu or Raja who had in himself the three branches of the government- executive, legislative and judicial. The elders acted as delegates, especially in the judiciary where they had conciliatory or arbitrational functions similar to those of the present-day Lupong Tagapamayapa or Pangkat ng Tagapagkasundo as provided for under the Katarungang Pambarangay Law. In addition, Loarca, a noted historian, says that the Chief, with the advise and consent of the elders, made laws.
The political government then, according to Father San Antonio, "was not monarchial, for they did not have an absolute king, or democratic, for those who governed a state or village were not many; but it was an aristocratic one, for there were many magnates among whom the entire government was divided". Succession to the Chief's position in the Barangay was hereditary but if there were no qualified heir, any man could rise to that rank by virtue of wisdom, physical power or wealth. Powers and Functions of the Sangguniang Kabataan

The Powers and Functions of the Sangguniang Kabataan according to Local Government Code of 1991 section 426 stated that the Sangguniang Kabataan shall:
  1. Promulgate resolutions necessary to carry out the objectives of the youth in the barangay in accordance with the applicable provisions of the LG Code.
  2. Initiate programs designed to enhance the social, political, economic, cultural, intellectual, moral, spiritual, and physical development of the members.
  3. Hold fund-raising activities, the proceeds of which shall be tax-exempt and shall accrue to the general fund of the sangguniang Kabataan: provided, however, that in the appropriations thereof, the specific purpose for which activity has been held shall be first satisfied.
  4. Create bodies or committees as it may deem necessary to effectively carry out its programs and activities.
  5. Submit annual and end-of term reports to the Sangguniang Barangay on their projects and activities for the survival and development of the youth in the barangay.
  6. Consult and coordinate with all youth organizations in the barangay for policy formulation and program implementation.
  7. Coordinate with the appropriate national agency for the implementation of youth development projects and programs at the national level.
  8. Exercise such other powers and perform such other duties and functions as the Sangguniang Barangay may determine or delegate.
  9. Exercise such other powers and perform such other duties and functions as may be prescribed by law or ordinance.

Barangay Officials & Barangay Council Difference

All of us may be heard about barangay officials and barangay council or Sangguniang Barangay in our place especially because we are all members in the Barangay. May be we used this words but we did not know what it mean because, did you know that this two words are not the same? I will tell you why, because when we talk about barangay officials it is composed of 11 individuals stated in the book Barangay primer second edition page 11 while the barangay council or sangguniang barangay is only compose of 8 individuals stated also in the same book page 42.

      The composition of barangay officials are:
  • (1) An elective Punong Barangay
  • (7) Elected barangay Kagawads
  • (1) Sangguniang Kabataan Chairman
  • (1) Barangay Secretary
  • (1) Barangay Treasurer
      While the barangay council or Sangguniang Barangay compose of:
  • (1) Punong Barangay
  • (7) Elected Barangay Kagawads
  • (1) Sangguniang Kabataan Chairman
Remember that next time be aware of using the word barangay officials and Barangay Council or Sangguniang Barangay.

The Basic Information About the Barangay

What is a Barangay? A barangay is the basic political unit which serves as the primary planning and implementing unit of government policies, plans, programs, projects and activities in the community, and as a forum wherein the collective views of the people may be expressed, crystallized and considered, and where disputes may be amicable settled. (Sec. 384)
What Law Governing the Barangay? The Local government Code of 1991 (RA 7160) and its Implementing Rules and Regulations referred to in this Primer as the Code and the Rules respectively.
What is the Scope of the LG Code and the Rules? The Code and the Rules apply to all Local Government Units and other political subdivisions as may be created by law and to the extent herein provided, to officials, offices, or agencies of the national government. In the case of the LGUs of autonomous regions the Code shall also apply until such time as the regional government concerned shall have enacted their own Local Government Code.
How is a barangay created? A barangay may be created, divided, merged, abolished or its boundary substantially altered, by law or by an ordinance of the Sangguniang Panlalawigan, or Panlungsod, subject to approval by a majority of the votes cast in a plebiscite to be conducted by the COMELEC. In case of the creation of barangays by the Sangguniang Panlalawigan, the recommendation o the Sangguniang Bayan concerned shall be necessary Notwithstanding the population requirement, a barangay may be created in the indigenous cultural communities by Act of Congress upon recommendation of the LGUs concerned where the cultural community is located. Requisites for creation of Barangays (Sec. 386)
  1. That the territory to be created should be contiguous or physically in contact with each other. However, if the territory is composed of two or more islands, they do not have to be contiguous.
  2. That the territory has a population of at least 2,000 inhabitants except the municipalities and cities within Metro Manila area and other metropolitan political subdivisions or in highly urbanized cities where such territory shall have a population of at least 5,000 inhabitants. Such population shall be duly certified by the National Statistics Office (NSO).
  3. That the creation of a new barangay shall not reduce the population of the mother barangay to less than the minimum requirement.
  4. That the territorial jurisdiction of the new barangay shall be properly identified by metes and bounds or by natural boundaries.
